Terms of Use

This English translation is provided for convenience only. In the event of any discrepancy, the German version is legally binding.

These Terms of Use govern the use of the Superkitchen app (the "Service"), provided by DBBC Ventures GmbH ("we"). By using the Service, you agree to these terms.

1.Service

Superkitchen helps families plan meals together, collect recipes, manage pantry and shopping, and optionally connect with befriended families. The basic features are provided free of charge in their current scope; for the paid AI features, section 7a additionally applies. There is no entitlement to specific features or uninterrupted availability.

2.Account and family

An account is required to use the Service. You are responsible for keeping your access credentials confidential. The person who creates a family is its owner and manages members and roles (Owner, Chef, Sous Chef, Kid).

You confirm that the information you provide is accurate and that you are of legal age or acting with the consent of a parent or legal guardian.

3.Children

Children may only use the Service together with a parent or legal guardian and under their responsibility. The parent or guardian who created the family decides about the data of the associated children and consents to its processing.

4.Your content

Recipes, photos, texts, and other content you post remain your content. You grant us the non-exclusive right to store and process this content and to display it to you and the people you have shared it with, solely for the purpose of providing the Service.

You confirm that you hold the necessary rights to your content and do not infringe any third-party rights.

5.Permitted use

You agree not to post any unlawful, offensive, harmful-to-minors, or rights-infringing content and not to misuse the Service, in particular not to scrape it automatically, disrupt it, or circumvent security mechanisms.

There is a zero-tolerance policy for objectionable content and abusive behavior. In the friends network you can report shared content and block families. Reported content is hidden immediately and reviewed.

In the event of violations, we may remove content, suspend access, and permanently exclude abusive users.

6.Sharing with befriended families

Content is private by default and only visible within your family. Only when you explicitly share a recipe does it become visible to the families you are connected with. When sharing, you are responsible for ensuring the content is intended for that audience.

7.AI feature

The optional AI feature generates recipe suggestions from photos. The suggestions are automatically generated estimates, may contain errors, and do not replace professional advice. Always check ingredients, amounts, and in particular allergy and intolerance information yourself before cooking.

7a.Paid AI features (subscription)

Use of the AI features is subject to a quota. Each family receives a one-time free starter quota of 15 AI credits. This free quota is not automatically refilled.

If you want to use more, you can take out a monthly subscription. Two plans are available: Superkitchen KI 100 for EUR 4.99 per month with 100 AI credits per billing month, and Superkitchen KI 400 for EUR 9.99 per month with 400 AI credits per billing month. The stated prices are final prices and include applicable VAT; the relevant local price is shown to you in the App Store before purchase.

One AI credit corresponds to one simple AI request. Depending on the selected AI model, a request may consume several credits; the consumption is shown to you before use. The monthly quota is available to you for the current billing period and is reset to the plan value at the start of each new period (based on the renewal date of your subscription, not the calendar month). Unused credits of a month expire with the reset. Additional bonus credits you receive outside the subscription (for example by inviting befriended families) do not expire and are retained on reset.

The subscription is assigned to your family; the quota is available to all eligible members jointly. The contracting party for the purchase is the person who takes out the subscription. If responsibility for the family changes or the purchasing person leaves, administration, renewal, and cancellation of the subscription continue to follow their Apple account.

Purchase, payment, and management of the subscription take place exclusively via your Apple account and the App Store. We do not use our own payment provider and do not receive payment data such as credit card numbers from Apple. The subscription renews automatically for one month at a time at the then-current price unless you cancel it at least 24 hours before the end of the current period. Cancellation is done via Apple's subscription management (on your device under Settings, your name, Subscriptions) and takes effect at the end of the period already paid for; there is no minimum term beyond that.

The AI quota is made available for immediate use directly after the contract is concluded. With your express consent to the immediate start of performance given during the purchase process and your acknowledgment that you thereby lose your right of withdrawal, your right of withdrawal expires pursuant to section 356 (5) of the German Civil Code (BGB). Consent, acknowledgment, and any refunds are obtained and handled by Apple as part of the App Store purchase process.

We may adjust plans, prices, and quotas for the future. A price increase for an existing subscription only takes effect after prior notice and in accordance with Apple's rules. We may change, replace, or temporarily disable individual AI models as long as an equivalent AI feature remains available for using your quota.

8.Availability and warranty

The Service is provided as a free service with the care of an average provider, but without any guarantee of specific properties. We may further develop, restrict, or discontinue the Service. Where reasonable, we will announce material changes in advance.

9.Liability

We are liable without limitation in cases of intent and gross negligence, as well as for injury to life, body, or health. In cases of simple negligence, we are only liable for the breach of a material contractual obligation and limited to the foreseeable damage typical for the contract. Any further liability is excluded. Mandatory statutory liability, for example under the German Product Liability Act, remains unaffected.

10.Term and termination

You can delete your account in the app at any time. We may terminate the usage relationship with reasonable notice, and without notice for good cause. When the account is deleted, the associated data is deleted in accordance with the Privacy Policy.

11.Changes to these terms

We may adjust these terms if features, the legal situation, or the services we use change. We will inform you of material changes in the app or by email. The current version is always available in the app.

12.Final provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the state of your habitual residence remain unaffected. Should any provision be invalid, the remainder remains in effect.
